"Know all men by these presents: That we, Christopher C. Gooding, and Caroline M. Gooding, husband and wife, parties of the first, for and in consideration of the sum of four hundred dollars in chash, the payment of all taxes on the premises hereinafter described, the balance of the court costs in the case of Christopher C. Gooding against Earl C. Gooding, et al., in the district court of Franklin county, Nebraska, and of assuming and paying any expense on acccount of litigating the claim of James McNerry and Bernard McNerry, against said premises, do hereby grant, bargain, sell, convey, confirm and release unto, M. Ellen Spalding, of the county of Franklin, and State of Nebraska, the following described real estate, situated in Franklin County, Nebraska, to wit: (description of 18.81 acres of land), owned and occupied by Mary S. Gooding, as a homestead at and prior to her death; together with and singular the hereditaments and appurtenances therunto unto the said M. Ellen Spalding, her heirs and assigns; so that neither they, the said grantors nor any person in their name and behalf, shall or will hereafter claim or demand any right or title to the said premises or any part thereof; but that they and every of them shall by these presents be excluded and forever barred."
